Mockup terms

These cover the free mockup only — the part where you send me a logo and some photos and I build your homepage with nothing signed and nothing paid. If you decide to go ahead, the service agreement governs from then on; these terms keep applying to the mockup phase that came before.
1. Your materials
You keep all rights to everything you send: logo, photographs, text, menus, prices. You give Fiumara Designs permission to store, copy, resize and display those materials for one purpose — building your mockup and showing it to you. That permission ends when the mockup is deleted.
2. Your confirmation, and what happens if it’s wrong
You confirm that you own, or have permission to use, everything you send, and that using it won’t infringe anyone else’s rights. I have no way to check where a photo came from, so I have to rely on you for this. If someone brings a claim against Fiumara Designs because of materials you supplied, you will cover the cost of defending and resolving it.
3. The mockup is private
Your mockup lives at an unlisted address, is hidden from search engines, and isn’t shown to anyone else without your say-so. It comes down whenever you ask, and in any case within 90 days of the last time we speak.
4. Changes
Two rounds of changes are included at no cost. A round is one set of feedback from you and my response to it. Beyond that, or for anything outside what a homepage mockup covers, I’ll quote you before starting.
5. What stays mine
The mockup page itself, the block and template system it’s built from, and the editor behind it remain the property of Fiumara Designs until we’ve agreed terms. You’re welcome to look at the mockup for as long as it exists; you don’t acquire a right to copy it, host it elsewhere, or hand it to another developer. Your own content is never part of that and is always yours to take.
6. No obligation, either way
Neither of us is committed to anything. You can walk away at any point and owe nothing. I may decline to build or continue a mockup for any reason.
7. Confidentiality
Anything you tell me about your business that isn’t public, I keep to myself. Same in reverse.
